NeverIX Velbert (“NeverIX”, “we”) is operated by Austin Hadley, Sole Proprietorship (Business Tax ID 92-0839915). These terms apply to every network (“member”) connected to NeverIX and to every user of the NeverIX member portal. By connecting to the exchange or using the portal, you accept these terms, the Acceptable Use Policy and the Privacy Policy.
01The service
NeverIX provides a shared Layer 2 peering LAN, route servers, a route collector and related tools (looking glass, statistics, member portal). Members exchange traffic with each other under their own bilateral or multilateral arrangements; NeverIX is not a party to those arrangements and does not provide IP transit.
02Eligibility
- You must operate a network with a public ASN and keep your RIR, IRR, RPKI and contact records accurate.
- You must provide a monitored NOC email address and keep your portal contact details up to date.
- We may decline or withdraw membership at our discretion, for example where a network has a history of abuse.
03Permitted connections
Connections to the peering LAN are only permitted through one of the following:
- a physical port, VLAN or cross-connect provided or approved by NeverIX at one of our locations;
- a virtual machine hosted on NeverIX infrastructure or on the infrastructure of one of our partners.
Connections via tunnels are NOT permitted. This includes GRE, VXLAN, EoIP, WireGuard, OpenVPN, IPsec and any other form of tunnelled or encapsulated Layer 2 or Layer 3 transport over the Internet or third-party networks. Virtual machines hosted elsewhere are not permitted either. We will disconnect any port found to be connected in violation of this section.
04Your obligations
- Comply with the Acceptable Use Policy and the Port Security Policy.
- Use only the IP addresses assigned to you on the peering LAN.
- Keep your equipment and configuration secure and up to date.
- Respond promptly to requests from the NeverIX NOC.
- Comply with all laws that apply to you and your traffic.
05Transit over the fabric
Members may sell or provide IP transit to other members over the NeverIX fabric, as long as it does not affect other members or the stability of the exchange. Such arrangements are solely between the members concerned.
06Fees
Unless agreed otherwise in writing, membership is currently provided free of charge. We will give at least 30 days’ notice by email before introducing any fees, and you may leave the exchange before they apply.
07Availability and maintenance
The exchange is operated on a best-effort basis. We aim for high availability but do not guarantee uninterrupted service or any service level. Planned maintenance will normally be announced by email in advance; emergency maintenance may be carried out without notice.
08Suspension and termination
- We may suspend a port or session immediately, without notice, where it threatens the stability or security of the exchange or breaches the AUP.
- We will normally contact you first and restore service once the issue is resolved.
- Either party may end membership at any time by email. We will remove your configuration and release your addresses.
09Liability
The service is provided “as is”. To the extent permitted by law, NeverIX is not liable for any indirect or consequential loss, loss of revenue, data or traffic, or for the acts of other members. Nothing in these terms limits liability that cannot be limited by law, including liability for intent or gross negligence.
10Changes to these terms
We may update these terms. Material changes will be announced to members by email at least 14 days before they take effect. The current version is always published on this page.
